TERMS OF SERVICE & GEOSPATIAL OPERATING AGREEMENT

SEC 1.0 Preamble, Binding Agreement & Scope of Applicability

PLEASE READ THESE TERMS OF SERVICE CAREFULLY BEFORE ACCESSING OR USING THE YANS MAP PLATFORM. BY DOWNLOADING, INSTALLING, EXECUTING, ACCESSING, OR INTERACTING WITH THE APPLICATION (VIA ANDROID APK PACKAGE, WEB ENGINE PORTAL AT yansmap.web.app, FLUTTER SDK yansmap, OR REST INTERFACES), YOU EXPRESSLY AGREE TO BE BOUND BY ALL TERMS, CONDITIONS, AND COVENANTS CONTAINED HEREIN.

This Agreement constitutes a valid, legally enforceable electronic contract under the provisions of the Information Technology Act, 2000 (India), the Digital Personal Data Protection Act, 2023 (DPDPA), and applicable international electronic commerce statutes. If you do not unequivocally assent to every clause of this Agreement, you must immediately terminate your access, uninstall the software, and refrain from utilizing any Yans Map services.

Throughout this document, "Yans Map", "The Platform", "The System", "We", "Us", or "Our" designates the proprietary geospatial technology ecosystem engineered by Lead Systems Architect Mohit Donawat and operated under MSD Innovations. "User" or "You" designates any natural person, legal entity, developer, or autonomous system interacting with the services.

SEC 2.0 Zero-Telemetry Architectural Model & Data Sovereignty Covenant

Unlike conventional commercial mapping corporations that monetize user mobility patterns, Yans Map operates under an immutable Zero-Telemetry, Client-Side Execution Mandate.

2.1 Local Storage Mechanics

Any user configurations—including offline favorite places, recent search queries, day/night theme preferences, and locally pinned route checkpoints—are persisted exclusively within your device's sandboxed client storage (e.g., Android Local Database, browser localStorage, or IndexedDB). Clearing your client application data or cache irreversibly purges this information from your physical hardware.

2.2 Cloud Synchronized Public Submissions

When you voluntarily submit a public product review (via the Ratings & Reviews portal) or transmit an operational ticket (via the Support & Feedback Portal), you authorize the transmission of your provided name, contact handle, and message body to secure cloud datastores solely for service facilitation and platform response by Founder Mohit Donawat.

SEC 3.0 The Physical Road Primacy Doctrine & Safe Navigation Disclaimer

Navigation, geocoding, turn-by-turn guidance, and spatial path calculation represent mathematical algorithmic approximations based on vector networks. You acknowledge and accept that:

• Driver Sovereignty: You retain 100% legal, civic, and operational responsibility for the safe operation of your motor vehicle, bicycle, or personal conveyance.
• No In-Motion Manipulation: You agree not to touch, adjust, type into, or physically interact with the Yans Map software interface while actively steering, driving, or maneuvering a vehicle in active traffic. Mount your device securely in compliance with local motor vehicle regulations prior to departure.
• Speedometer & Compass Precision: Speedometer readouts, heading bearings, and ETA calculations are non-certified, consumer-grade estimations derived from device GNSS chips. They do not substitute for calibrated vehicular speedometers or maritime/aviation compasses.
• Road Classifications: Terrain, private roads, gated communities, pedestrian walkways, or seasonal hazards may undergo unmapped modifications. Never enter restricted property, closed highways, flooded underpasses, or hazardous terrain based on algorithmic paths.

SEC 4.0 Atmospheric Weather Radar & Environmental Intelligence

Yans Map incorporates live weather overlays delivering precipitation rates (mm/h), ambient temperatures, wind velocities, and atmospheric pressure metrics.

All meteorological data points represent computational numerical simulations. Weather patterns—including micro-bursts, sudden squalls, fog density, black ice, and flash floods—can develop unpredictably. Yans Map makes no warranty regarding the instantaneous infallibility of rain radar visualizations and shall not be held liable for property damage, travel delays, or maritime/aviation hazards stemming from environmental fluctuations.

SEC 5.0 Public Traffic CCTV Feeds & Situational Relay

Interactive traffic camera pins allow users to inspect public intersection and highway stream feeds prior to initiating travel.

• Public Availability: Camera markers aggregate publicly accessible transport surveillance streams provided for vehicular flow management. Stream uptime, frame rate, and field of view remain subject to metropolitan infrastructure availability.
• Prohibition of Misuse: You are strictly prohibited from utilizing traffic camera feeds for unlawful surveillance, stalkerware deployment, individual identification, or violation of individual privacy rights under applicable data protection laws.

SEC 6.0 Crowdsourced Road Hazard Intelligence & Community Integrity

Yans Map empowers registered and anonymous community members to broadcast real-time hazard markers, including Police Checkpoints 👮, Dangerous Potholes ⚠️, Traffic Congestion 🚗, and Road Accidents 💥.

6.1 User Warranty of Truthfulness

By publishing any hazard report, you warrant and represent that:

1. The hazard reported corresponds to an actual, contemporaneous, and personally observed physical impediment or law enforcement checkpoint.
2. You are not submitting false, malicious, deceptive, or spam markers designed to artificially deflect traffic, harass authorities, or disrupt navigational flow.
3. You acknowledge that automated algorithmic consensus mechanisms, peer down-votes, or geographical spoofing detection may automatically extinguish or invalidate reports deemed fraudulent.

SEC 7.0 Intellectual Property, Code Protection & Anti-Reverse Engineering

The Yans Map platform, including its proprietary client-side polyline routing solvers, obfuscated execution runtime, custom map shaders, dark/light inversion stylesheets, vector icons, sound cues, brand nomenclature, and the trademark "Yans Map 🗺️", is the exclusive intellectual property of Mohit Donawat 👑 (MSD Innovations) and protected under domestic and international copyright, trade secret, and intellectual property treaties.

SEC 8.0 Developer SDK, Web iFrame Embed & API Utilization Terms

Developers integrating the Yans Map Flutter SDK (yansmap), Web iFrame embedding syntax, or REST geocoding endpoints agree to adhere to the following developer covenants:

SEC 9.0 Disclaimer of Warranties & Absolute Limitation of Liability

TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, THE YANS MAP PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

MSD INNOVATIONS AND LEAD ARCHITECT MOHIT DONAWAT EXPRESSLY DISCLAIM ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR GEOSPATIAL PURPOSE, SYSTEM INTEGRATION, TITLE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED AVAILABILITY.

UNDER NO CIRCUMSTANCES SHALL MOHIT DONAWAT, MSD INNOVATIONS, OR ASSOCIATED CONTRIBUTORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Traffic citations, fines, or penalties imposed by law enforcement.
• Vehicular collisions, personal bodily injury, or vehicular damage occurring while operating in proximity to generated navigational routes.
• Missed business appointments, lost commercial profits, or delay-related liabilities.
• Telecommunication carrier data fees or cellular battery depletion.

SEC 10.0 User Conduct & Acceptable Use Policy (AUP)

You agree not to misuse the Yans Map platform. Specifically, you shall not:

• Inject mock GNSS locations to artificially distort hazard consensus or falsify platform speedometers.
• Deploy automated crawlers, scrapers, spider bots, or denial-of-service stress tests against the platform infrastructure.
• Submit unlawful, defamatory, profane, or abusive text in user reviews or feedback tickets.
• Attempt to breach the security safeguards, sandboxing, or cryptographic integrity of the application.

SEC 11.0 Governing Law, Dispute Resolution & Mandatory Arbitration

This Agreement, and any dispute, controversy, proceedings, or claim of whatever nature arising out of or in any way relating to this Agreement or its formation, shall be governed by and construed in accordance with the laws of the Republic of India, without regard to conflict of laws principles.

11.1 Informal Settlement Precondition

Prior to initiating any formal legal or arbitral proceedings, the aggrieved party agrees to deliver written notice of the grievance to the Office of the Lead Architect. Both parties shall engage in good-faith negotiations for a minimum period of thirty (30) business days to reach an amicable resolution.

11.2 Binding Arbitration

Failing informal resolution, all disputes shall be referred to and finally resolved by binding individual arbitration administered under the Arbitration and Conciliation Act, 1996 (India). The arbitration shall be conducted by a sole arbitrator mutually appointed by the parties, in the English language, with seat and venue designated in New Delhi / Rajasthan, India.
